Should you be awarded a contract with Fortney & Weygandt, Inc., please be advised of new insurance/workers’ compensation requirements effective July 1, 2003.
Upon execution of this Agreement, and prior to the Sub’s commencing any work or services with regard to the Project, Sub shall carry commercial general liability insurance on ISO form CG 00 001 10 01 (or a substitute form providing equivalent coverage) and Sub shall provide F&W with a Certificate of Insurance and Additional Insured Endorsement on ISO form CG 20 10 11 85 (or a substitute form providing equivalent coverage) or on the combination of ISO forms CG 20 10 10 01 and CG 20 37 10 01 (or substitute forms providing equivalent coverage) naming F&W and the Owner as Additional Insured thereunder. Additional insured coverage shall apply as primary insurance with respect to any other insurance afforded to Owner and F&W. The coverage available to F&W and Owner, as Additional Insureds shall not be less than $1 million dollars Each Occurrence, $2 million General Aggregate (subject to a per project general aggregate provision applicable to the project), $2 million Products/ Completed Operations Aggregate and $1 million Personal and Advertising injury limits. Such insurance shall cover liability arising from premises, operations, independent contractors, products-completed operations, personal and advertising injury, and liability assumed under an insured contract (including the tort liability of another assumed in a business contract). There shall be no endorsement or modification of the Commercial General Liability form arising from pollution, explosion, collapse, underground property damage or work performed by Subs. All coverage shall be placed with an insurance company duly admitted in the State of ___________ and shall be reasonably acceptable to Contractor. All Sub insurance carriers must be “A” rated. Coverage shall be afforded to the Additional Insureds whether or not a claim is in litigation.
The insurance coverage required under this Work Order shall be of sufficient type, scope and duration to ensure coverage for F&W or Owner for liability related to any manifestation date within the applicable statutes of limitation and/or repose which pertain to any work performed by or on behalf of F&W or Owner in relation to the Project. Sub agrees to maintain the above insurance for the benefit of F&W and Owner for a period of four years, or the expiration of the applicable statute of limitations period, whichever is later.
Each Certificate of Insurance shall provide that the insurer must give F&W at least 30 days’ prior written notice of cancellation and termination of F&W’s coverage thereunder. Not less than two weeks prior to the expiration, cancellation or termination of any such policy, the Sub shall supply F&W with a new and replacement Certificate of Insurance and Additional Insured endorsement as proof of renewal of said original policy. Said new and replacement endorsements shall be similarly endorsed in favor of F&W and Owner as set forth above.
Additionally and prior to commencement of the Work, the Sub shall provide F&W with a Certificate of Insurance showing liability insurance coverage for the Sub and any employees, agents or subcontractors of the Sub for any Workers’ Compensation, Employer’s Liability and Automobile Liability. In the event any of these policies are terminated, Certificates of Insurance showing replacement coverage shall be provided to F&W. Coverages shall be no less than the following;
a. Unless the Work is being done in a state requiring workers’ compensation through a state funded agency, Workers’ Compensation and Employers’ Liability Insurance as required by law and affording thirty (30) days written notice to F&W prior to cancellation or non-renewal, providing coverage of not less than $1,000,000 for bodily injury caused by accident and $1,000,000 for bodily injury by disease.
b. Business Auto Liability Insurance: Written in the amount of not less than $1,000,000 each accident.
Waiver of Subrogation: Sub shall obtain from each of its insurers a waiver of subrogation on Commercial Liability in favor of Contractor and Owner with respect to Losses arising out of or in connection with the Work.

have been in business over 20 years, manage in excess of $100,000,000 in construction volume yearly, and have a full time staff of 200 office and field personnel. We accept both open shop and/or union bids from subcontractors as the job dictates.
Our firm offers a 2%, 10-day discount on the monthly billing.
We will endeavor to notify every bidder of their status on the project within 72 hours of the bid.
It is our desire to be the most professional general contractor in our market. To accomplish this goal we ask for your feedback whenever it is appropriate to do so. It is with this desire to improve ourselves that we have established the following terms and conditions in which to accept and review bids received by our firm.
All bids MUST be per plans and specifications.
All plans and specifications must be picked by the subcontractor/supplier. Fortney &
Weygandt, Inc. will NOT pick plans and specifications. Substitutions must be noted as such. The base bid MUST be per plans and specifications.
Value engineering is always encouraged, provided it is listed as a line item alternate.
Fortney & Weygandt, Inc. will do our best to analyze and qualify subcontractor bids.
However, Fortney & Weygandt, Inc. is not responsible for the completeness of any bid.
Any bid received after the set time on the bid invitation (which is 4 hours before our bid
is due,) Fortney & Weygandt, Inc. will not have the time to analyze properly and will be
taken at its face value, per plans and specifications.
